Cohen - USE OF THE POLYGRAPH IN SECURITY CLEARANCE DETERMINATIONS USE OF THE POLYGRAPH IN SECURITY CLEARANCE DETERMINATIONS On March 31, 1998 a divided Supreme Court, in held that the results of a polygraph exam could be banned from use in a criminal trial by either side because there is simply no consensus that polygraph evidence is reliable. The Court found that the scientific community and the State and Federal courts are extremely polarized on the matter.
